



OFP attorneys Lars Anderson, Sally Ann Hostetler, Charlotte Rosen and Jim Miller recently won a victory for client CW Government Travel in the US Court of Federal Claims. The decision blocks the execution of a $47 million contract to provide travel services to the US Army and found that the General Services Administration (GSA) unfairly competed the work by failing to adhere to bidding requirements.
Principally, Claims Court Judge Zachary Somers noted that BCD Travel USA LLC, to whom GSA awarded the work, did not meet the key personnel experience requirements. Further, in what the judge described as a “tortured” argument, the Court agreed with CW Government Travel’s assessment that the GSA failed to perform a proper price realism analysis.
The judgment favoring CW Government Travel bars the government from securing any travel services under the previously awarded BCD contract and requires that any subsequent reevaluation of proposals “…be performed in a manner that is consistent with this opinion.”
