In Sept. 2020, the government awarded a $50M contract to the wrong company – i.e., not OFP’s client, who was also the incumbent. OFP filed and prosecuted multiple protests with the Government Accountability Office (GAO) and U.S. Court of Federal Claims (COFC). When the COFC ordered the termination of the award in June 2021 and reevaluation, the government cancelled the procurement and issued a new solicitation with changes that would make it easier to award to the original awardee. OFP again filed GAO and COFC protests. Finally, in July 2022, the government did the right thing and awarded a new five-year, $50M contract to OFP’s client. Since our client was the incumbent, it continued performing the contract during the almost two-year protest litigation.
