Sarah A. Belger, Shareholder

Sarah Belger focuses her practice on labor and employment law, with particular emphasis on employment-related litigation.  Ms. Belger has significant experience, including first-chair trial experience, defending employers before federal, state and appellate courts, as well as before administrative agencies and in arbitration settings.  She counsels and defends clients in claims under Title VII, the American Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), the Employee Retirement Income Security Act (ERISA), the Family and Medical Leave Act (FMLA), the Fair Labor Standards Act (FLSA), the Uniformed Services Employment and Reemployment Rights Act (USERRA), and other federal, state and local laws.

Sarah’s practice includes:

  • Employment discrimination, retaliation and wrongful discharge
  • Non-compete and non-solicitation negotiation and litigation
  • Civil business conspiracy and tortious interference claims
  • Executive contracts
  • Whistleblower and retaliation litigation
  • Trade-secret disputes
  • Business torts, including defamation, and
  • Claims under ERISA, including claims for benefits, breach of fiduciary duty, multi-employer plans, withdrawal liability, and employee stock ownership plans (ESOPs).

In addition to her litigation experience, Sarah also advises clients on employment policies and procedures, internal investigations, drafting executive agreements, and disability accommodation.  She represents a wide variety of companies and industries, including government contractors, professional services, IT, health care, hospitality and nonprofit organizations.

In practice for more than 12 years, Sarah has been recognized as a leading labor/employment attorney by Virginia Business magazine’s annual “Legal Elite” listing, and as a “Virginia Rising Star” and “Washington, D.C. Rising Star” by Super Lawyers.

Va. 2016) (granting summary judgment against ESOP participant who had signed a release of claims against his former employer, which included a release of  claims against  trustees)  (currently  on appeal).
  • Krpan Registry of Interpreters for the Deaf, 167 F. Supp. 3d 774 (E.D. Va. 2016) (public accommodation claims under the ADA).
